- Initial Resolution: Users are encouraged to contact Ariba Safety Customer Service to resolve any disputes, claims, or issues arising from the use of the website or services. We aim to address all concerns promptly and amicably.
- Mediation and Arbitration: If a dispute cannot be resolved through initial resolution, the parties agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) by binding arbitration. Arbitration is a more informal way to resolve disputes than a lawsuit in court. The arbitration will be conducted in accordance with the rules of the Canadian Arbitration Association.
- Arbitration Procedures:
- The arbitration will be conducted by a single, neutral arbitrator and will take place in Ontario, Canada.
- The arbitrator’s decision will follow the terms of these ToS and will be final and binding. The arbitrator will have authority to award temporary, interim, or permanent injunctive relief or relief providing for specific performance of these ToS, but only to the extent necessary to provide relief warranted by the individual claim before the arbitrator.
- The arbitrator’s award can be confirmed and enforced in any court of competent jurisdiction.
- The arbitrator will not have the authority to award damages, remedies, or awards that conflict with these ToS.
- Class Action Waiver: You and Ariba Safety agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. Neither you nor Ariba Safety will seek to have any dispute heard as a class action or in any proceeding in which either party acts or proposes to act in a representative capacity.
- Governing Law
- Applicable Law: These ToS and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to its conflict of law principles.

- Injunctive Relief: In the event of a breach or threatened breach of these ToS, Ariba Safety may seek injunctive or other appropriate relief in any court of competent jurisdiction. This provision shall not in any way limit the rights or remedies otherwise available to Ariba Safety, including the right to seek damages.
- Limitation of Liability: To the maximum extent permitted by applicable law, Ariba Safety shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the website or services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the website; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
